SECTION 1. AUTHORITY. Under the authority granted in 24 V.S.A. Chapter 59, 24 V.S.A. §2291(4), 23 V.S.A. §1008, and 19 V.S.A. §304(a)(6), the Selectboard of the Town of Brighton hereby adopts this civil ordinance regulating parking.
SECTION 2. PURPOSE. The purpose of this ordinance is to promote safety, to provide good traffic flow and to assist the Town in the maintenance of streets and highways.
SECTION 3. SEPARATE OFFENSES. Each violation of a provision of this ordinance shall be deemed a separate offense.
SECTION 4. WINTER PARKING. It shall be unlawful for vehicles to be parked within the public right-of-way of the Town streets or highways during the hours of 1:00 AM to 6:00 AM from November 15 to April 15.
SECTION 5. NO PARKING AREAS. It shall be unlawful to park:
A. On the south side of Railroad St. from Alder St. west to where the state highway begins;
B. Fewer than 20 feet from a pedestrian crosswalk or an intersection;
C. In any area where official “No Parking” signs are posted;
D. Where there is a yellow curb and/or the designation “Fire Lane;”
E. On a public sidewalk.
SECTION 6. ENFORCEMENT AND PENALTIES. Vehicles parked in violation of these regulations may be towed by order of any certified police officer, at the expense of the owner. In addition to towing, a penalty of $35 shall be assessed for each violation. A waiver fee is set of $15. Enforcement of this ordinance shall be by any certified police officer.
SECTION 7. EFFECTIVE DATE. This ordinance shall become effective 60 days after its adoption by the Brighton Selectboard. If a petition is filed under 24 V.S.A. §1973, the effective date shall be governed by that statute.
SECTION 8. REPEAL OF PRIOR ORDINANCES. Any other ordinance or regulation in conflict with this ordinance is hereby repealed.
SECTION 9. SEVERABILITY. If any section of this ordinance is held by a court of competent jurisdiction to be invalid, such finding shall not invalidate any other part of this ordinance.
